Massachusetts Seventh Grader Appeals Court Ruling on T-Shirt Controversy
A Massachusetts seventh grader is fighting back after a federal court ruled against him for wearing a shirt that boldly proclaimed “There are two genders.” Liam Morrison, along with Middleborough’s Nichols Middle School, has filed an appeal in hopes of overturning the decision.
The U.S. District Court for the District of Massachusetts Eastern Division had previously sided with the school, allowing them to dictate which messages could be displayed on T-shirts. Morrison had already tested the school’s policy by wearing a shirt that read ”There are censored genders” after being asked to change his shirt twice.
Championing Freedom of Expression
Morrison’s attorney, Logan Spena, passionately argues, “This isn’t just about a T-shirt; it’s about a public school stifling a middle-schooler’s right to express a viewpoint that differs from the school’s orthodoxy. Liam should not be forced to remove a shirt that simply states his position, especially when other students are allowed to wear clothing expressing their own views on the same issue. The school’s decision to silence him and double down on their censorship is a clear violation of the First Amendment, and we are urging the 1st Circuit to rectify this injustice.”
Spena is affiliated with the conservative group Alliance Defending Freedom (ADF), which initially filed the lawsuit in May. Since the court ruling, Morrison has been prohibited from wearing the controversial shirt. Now, Spena is seeking permission from the appellate court to allow Morrison to continue wearing the shirt at school.
Despite multiple requests for comment, Middleborough Public Schools have remained silent on the matter.
Before resorting to legal action, Morrison’s parents, Christopher and Susan, had attempted to obtain permission from the school superintendent for their son to wear the shirt. Unfortunately, their request was denied, along with another request made by an attorney.
