Manhattan prosecutors opened an investigation into Trump’s falsification of business records in order to claim the reimbursement as legal expense. This crime is considered a misdemeanor by New York, but it could be made a felony by Bragg’s office if the fraud was meant to cover up another crime.

Federal prosecutors didn’t press charges against Trump at Cohen’s trial due to the Justice Department’s guidance that a sitting president can not be charged with any crime. However, the prosecutors reopened discussions on possible charges shortly after Trump’s departure in 2021.
