The Michigan court⁤ upheld the decisions ⁣of two lower courts, ruling 3-0 that the plaintiff’s case was untimely. However, the court did not address whether Trump was subject to disqualification under Section 3 of the 14th Amendment.

“As the Court of Claims recognized, it would be improper to⁣ decide‍ whether to⁢ grant a declaration that Trump is disqualified from holding the office of President of the United States at this time,” the ⁣court wrote.

“At⁢ the moment, the only event about to occur is the presidential primary election. But as explained, whether Trump is disqualified is irrelevant to his placement on that particular ballot. Thus, with respect to ‌the presidential primary election, there is no actual controversy, ⁤as the only purported basis for removing Trump from ⁣the presidential primary ballot would not be ⁢a sufficient basis for removal⁢ of Trump’s name from ‍that ballot,” the court⁢ stated.

The ruling was⁢ praised by Trump’s team on Thursday night.

“With the Michigan Court of Appeals’ affirmation of ‍the Trump campaign’s victories in the lower court, the Soros-funded Democrats have once again failed in their desperate attempt to interfere in the⁤ election via a bad-faith interpretation of the 14th Amendment. President Trump⁢ remains undefeated against these frivolous legal claims and has never been in a stronger position ⁣to win next year’s election,”⁣ campaign spokesperson Steven Cheung said in a statement.

What was the basis ⁣of the Court of Appeals’ ruling in favor of including Donald Trump on Michigan’s GOP primary ballot?

Title: Court of Appeals Rules in Favor of Donald‌ Trump’s Inclusion on Michigan’s 2024 GOP Primary Ballot

Introduction

The Court of Appeals in Michigan has made a significant ruling regarding ⁢the⁢ inclusion of former President Donald Trump on the state’s 2024 GOP primary ballot. The court dismissed an appeal from the watchdog group Free Speech For People, nullifying their attempt to ⁢prevent Trump’s candidacy. This decision has‌ raised ‌debates on matters of legality and disqualification under Section 3 of the 14th Amendment. Let’s delve into the details ‍of this ruling and its implications.

Background

On Thursday, the ⁢Michigan Court of⁤ Appeals rendered a unanimous verdict to uphold the‌ decisions made by ⁢two lower courts. ‌The ruling concluded that the appeal from Free Speech For People, brought ⁤forth on behalf ⁣of a group of Michigan voters, was filed too late and therefore deemed untimely by the court. However, ⁣the court did⁢ not specifically address ⁢the question of whether Trump would be subject to disqualification‍ under Section⁤ 3 of the 14th Amendment.

Court’s Justification

The Court of Appeals was careful not to make a determination on Trump’s potential disqualification⁢ from holding the office of President ⁤of the United States. It underscored that deciding on this matter at the present⁢ moment, with‌ the presidential primary election approaching, ‌would be premature. The court emphasized that Trump’s placement on the primary ballot is unaffected by his disqualification status, ‍stating that his disqualification would not ⁤be a ⁣sufficient basis for ⁤removing his name from that particular ballot.

Reaction from Trump’s Team

The court’s ruling‌ received praise from Trump’s⁢ team, highlighting their satisfaction with the decision. They expressed relief⁢ that the Soros-funded Democrats failed in their alleged⁣ attempt to interfere in the election process by misinterpreting the 14th Amendment. Trump’s team celebrated their victories in the lower court and saw ‌the court’s ⁣ruling as a ‍testament to the former president’s record of success against his⁤ opponents.

Conclusion

The Court of Appeals in Michigan has upheld the inclusion of⁢ Donald Trump on⁣ the state’s 2024 GOP‍ primary ballot. This ruling dismisses ‌the appeal from Free Speech For People, asserting that it was filed‍ too late and as such, ‌regarded as untimely. While not ⁣explicitly addressing the question of Trump’s disqualification under the 14th Amendment, ⁣the court emphasized that his disqualification status is ‌irrelevant to his placement on ‌the primary ballot. Trump’s team welcomed the decision as⁤ another victory in their ongoing battles against their opponents. The implications of this ruling in⁢ the broader context of the 2024 presidential race will undoubtedly be closely observed.
