In a Landmark Decision, Fifth Circuit Court of Appeals Strikes Down Unconstitutional Mississippi Law
In a groundbreaking ruling on Friday, the Fifth Circuit Court of Appeals delivered a resounding blow to an unjust provision in the Mississippi Constitution. Section 241, which imposed permanent disenfranchisement for certain crimes, was declared unconstitutional under the Eighth Amendment’s prohibition against cruel and unusual punishment.
This historic decision comes as a result of a class-action lawsuit filed in 2018 by six brave Mississippi citizens who had been permanently disenfranchised. With the invaluable assistance of the Southern Poverty Law Center, they challenged the constitutionality of Sections 241 and 253 of the state’s constitution.
