The recent charges against Donald Trump involving classified documents raise two important questions. First, should he be prosecuted? And second, did he violate the actual law?
Did Trump Violate the Law?
Let’s address the second question first, based on the allegations presented by the indictment. If Jack Smith has the evidence to support those allegations (and it seems he does), then yes, Trump did violate the law.
The current version of the indictment highlights a tape where Trump shows classified documents to individuals without security clearance. He had the power to declassify them, but chose not to. Initially, Trump claimed that the document he showed them wasn’t classified, but Jack Smith now alleges that they were indeed classified documents. If witness testimony proves this, Trump’s defense on that matter falls apart.
Furthermore, the indictment alleges that another Trump aide, a maintenance person at Mar-a-Lago, attempted to destroy evidence of Trump’s people handling classified documents. It also claims that Trump ordered the security tapes to be wiped. These actions align with Smith’s accusation of obstruction.
Should Trump Be Prosecuted?
Now, let’s address the first question: should Trump be prosecuted? The answer is no. He should not be prosecuted. In 2016, Hillary Clinton was not charged for the same crimes Trump is now accused of, including wiping servers and exposing classified information to unauthorized individuals.
Remember when Clinton instructed her immigrant maid to print out classified information and even enter a sensitive compartmented information facility (SCIF) to pick up classified faxes, including the Presidential Daily Brief? Remember when Clinton’s tech firm used BleachBit to erase her private server’s classified emails, and she joked about it, asking if it had been wiped “like with a cloth”?
Yet Clinton was not prosecuted. Why? Because, as then-FBI Director James Comey stated, despite the possibility of foreign actors accessing classified materials, Clinton did not have the intent to distribute them to foreign actors. Comey essentially rewrote the law to avoid charging her because she was a presidential candidate.
Now, the Department of Justice is coming down hard on Trump.

The double standard in our justice system is glaringly obvious. It poses a greater threat to our country than Trump’s mishandling of classified information, which was not driven by any malicious security threat, but rather by Trump’s tendency to hoard materials he personally likes.
If half the country rightly believes that when Republicans commit crimes, they go to jail, but when Democrats commit crimes, they get lenient plea deals, the credibility of our entire justice system crumbles.
Interestingly, new charges were brought against Trump the day after Hunter Biden received a favorable plea deal, embarrassing the Department of Justice in the process. The irony is not lost on anyone.
So, no, Trump should not be prosecuted. While his handling of classified materials may have been illegal and certainly foolish, it pales in comparison to the national security threat posed by Hunter Biden’s questionable activities in Ukraine while his father oversees foreign policy.
And deep down, everyone knows it.
