Former President Obama Applauds Supreme Court Ruling Against Independent State Legislature Theory

Former President Barack Obama has voiced his support for the recent Supreme Court ruling that rejected the independent state legislature theory. In a tweet, Obama described the theory as a “fringe… theory that threatened to upend our democracy and dismantle our system of checks and balances.”

Prior to having lunch with President Joe Biden at the White House, Obama expressed his approval of the ruling. This lunch meeting marks a rare post-presidency trip for Obama, who last visited the executive mansion in September 2022. Biden, who served as Obama’s vice president from 2009 to 2017, joined him for the meal.

“This ruling rejects the far-right theory that threatened to undermine our democracy, and makes clear that courts can continue defending voters’ rights — in North Carolina and in every state,” Obama stated.

The Supreme Court ruled 6-3 in Moore v. Harper against the independent state legislature theory. This theory argues that a state’s courts are not allowed to override congressional maps drawn by the state legislature. The court’s decision emphasized that this theory “does not insulate state legislatures from the ordinary exercise of state judicial review.”

The ruling dealt a blow to Republicans in North Carolina who aimed to prevent the courts from redrawing congressional maps that favored the GOP. The state Supreme Court had previously invalidated these maps.

After Republicans gained the majority on the North Carolina Supreme Court, the high court dismissed a ruling from the previously Democratic-majority court regarding the congressional maps. This dismissal paved the way for the legislature to redraw the districts. Despite the state court ruling being thrown out, the legislatures involved in the lawsuit requested the federal Supreme Court to rule on the merits of the legal theory.
