Official Appointed by Biden Wanted to Ban Gas Stoves: Memo

According to a leaked memorandum, Joe Biden appointed a federal official to ban gas stoves.

“There is sufficient information available for CPSC to issue an NPR in FY 2023 proposing to ban gas stoves in homes,” Richard Trumka Jr. is a U.S. Consumer Product Safety Commission (USCPSC) commissioner who wrote the Oct. 25, 20,22, memo.

NPR stands for notice of proposed rulemaking while FY stands for fiscal year.

The Committee to Unleash Prosperity obtained the memo and The Epoch Times reviewed it.

Trumka Jr. caused a stir in January when he stated that all options were available for gas stoves.

“My guiding duty is protecting consumer health and safety. Gas stoves can emit dangerous level of toxic chemicals—even when not in use—and CPSC will consider all approaches to regulation,” Trumka Jr. stated the same at the time.

U.S. lawmakers, including Senator Joe Manchin (D.W.Va.), have criticised the flotation of a ban. and Sen. James Lankford (R-Okla.). Others have urged CPSC to impose additional regulations on gas stoves.

Trumka’s remarks were quickly refuted by other officials.

“I am not looking to ban gas stoves and the CPSC has no proceeding to do so,” Chair of the CPSC Alex Hoehn–Saric stated in a statement. In a statement, the White House said that President Joe Biden would not endorse a gas stove ban. “is not banning gas stoves.”

According to the Associated Press, New York Times, as well as other agencies, fact-checking articles claimed that the administration wasn’t going to or trying ban stoves. This claim was contradicted by the leak memo.

Trumka stated in the document, addressed at Peter Feldman, the need for regulation of gas stoves “has reached a boiling point” As “emerging evidence” That was the result “gas stoves in homes emit toxic gasses that cause illnesses and that lower-cost, safer alternatives are available.” He cited a New York University School of Law paper, in which he cited papers that had found high nitrogen dioxide levels within homes with gas stoves. “address the risks of indoor air pollution from gas stoves.” He also pointed out that gas stoves have been banned in New York City and Los Angeles for newly built buildings.

Federal law gives the CPSC the authority to regulate products that emit toxic chemicals. The commission must determine that the danger is severe enough to warrant a ban before it can impose a ban.

“Procedurally, a ban would require several findings in the regulatory analysis—in summary: (1) there is no relevant voluntary standard, the voluntary standard is insufficient, or substantial compliance with the voluntary standard is unlikely: (2) the expected benefits of the rule bear a reasonable relationship to its costs, considering the distribution of benefits and costs; and (3) the regulation is the least burdensome way to adequately reduce the risk of injury,” Trumka wrote.

There is already evidence that the stoves’ emissions are toxic, but there isn’t a voluntary standard for this, he said. Additionally, “the costs of installing new electric stoves are typically lower than the costs of installing new gas stoves, even without the subsidies,” So “the costs of the rule to consumers would be negligible.”

The White House, Trumka and the CPSC did not respond to our requests for comment.

The memo that was leaked “proves [the] Biden administration intended to ban gas stoves,” the Committee to Unleash Prosperity said.

Biden Nominee

The CPSC (Consumer Product Safety Commission) is an independent federal agency that imposes regulations regarding consumer products. It also develops mandatory standards and investigates potential hazards.

Biden nominated Trumka Jr. for the commission in July 2021. At the time, Trumka was a lawyer for the U.S. House of Representatives’ Committee on Oversight and Reform.

The Senate approved the nomination through a voice vote.

Trumka Jr. is eligible for seven years.

Feldman is a Trump appointee, whose term will end in 2026. Mary Boyle is the third commissioner and is an appointee of Biden. Hoehn–Saric is another Biden appointee.

Proposal Advance

Trumka’s proposed notice of rulemaking was not issued, but a different notice has been.

A notice was issued by the CPSC on March 7th for information “on chronic hazards associated with gas ranges and proposed solutions to those hazards.”

“We are looking for research on the health hazards associated with gas exposure, data on chemical emissions, test methods, and effective solutions with cost-benefit analyses,” Trumka spoke.

Feldman voted against, but the three Biden appointees voted for it.

Trumka proposed a notice for rulemaking on gas stoves during a meeting of 2022 commissioners. However, he acknowledged that it was not supported by other commissioners. He presented the notice as a substitution.
