Rep. Gonzales suggests defunding the FDA if the trump administrator ignores the decision on the abortion medication.
If the Biden administration overturns a court decision that suspended approval of the abortion pill mifepristone, Rep. Tony Gonzales( R-Texas) has stated that defunding the Food and Drug Administration ( FDA ) may be an option.
Gonzales, a member of the Appropriations Committee, suggested that House Republicans may decide to have the administration accountable by using the” power ofthe pocket.”
Gonzales said during an exam for CNN’s’s” State of the Union” on April 9 that it was” pretty scary when you have the leadership, the Biden presidency ,” coming out and saying they might not preserve a decision.”
The House Republicans, in my opinion, have the authority to use the pocket as an appropriator on the House Democratic hand.
We’re’re going to have a problem if the administration wants to not lead this ruling and not live up to it. And it might get to the point where House Republicans on the arrangement side are forced to stop funding FDA initiatives that are absurd.
Gonzales, a father of six who considers himself to be” profoundly pro-lifer ,” emphasized that it’s’s crucial to respect court rulings.
” I believe it’s’s crucial that we return and give our institutions the reins to govern. When we disagree with things that are in place, whether they are at the state level or not, we cannot erode them, he said.
He used the legalization of marijuana in California and many states as an illustration, but not in Texas.
Play it through your position and through the national levels if those are the kinds of things that your community wants, he continued. But we must maintain our organizations. It’s’s risky when we erode them.
Rulings
Trump’s’s Texas appointment, U.S. District Judge Matthew Kacsmaryk, issued an injunction on April 7 ordering the FDA to continue to approve mifepristone.
” Reads the judge’s’s decision Friday. The Court does not second-guess FDA decision-making lightly.” However, in this instance, FDA complied with its legitimate security concerns— in violation of its legal responsibility— based on blatantly flawed logic and studies that did not back up its conclusions.
The same day, President Joe Biden declared in a speech that his management” will challenge this decision.”
If this decision were to come, there would essentially be no FDA-approved prescription that would be shielded from these kinds of democratic, intellectual attacks, Biden continued.
Attorney General Merrick Garland also stated in a statement that he” strongly disagrees” with the court’s’s decision and that the Justice Department will” continue to” support the FDA decision.
The FDA argued that the abortion medication was” safe and effective” when it appealed the court’s’s ruling on Saturday.
According to a declaration from the FDA, Mifeprex was approved more than 20 years ago after being thoroughly reviewed and found to be safe and reliable. The FDA stands by its resolve.
Everything is on the table, according to Health and Human Services( HHS ) Secretary Xavier Becerra, who suggested that the administration might defy the judge’s’s court order on Sunday.
U.S. District Court Judge Thomas Rice, an Obama appointee in Spokane, Washington, ordered the FDA neither to make any changes that would limit access to mifepristone in a split decision on Friday. The decision was made in 17 state and the District of Columbia, where Democrats filed lawsuits to increase exposure to the contraception pill.
Reactions
The decision of Kacsmaryk has received condemnation from a number of Democrats.
Sen. Dianne Feinstein( D-California ) issued a statement describing the decision as” appalling.”
However, she added,” This decision wasn’t about ensuring drug safety or safeguarding patients.” It was obvious that the goal of this was to undermine women’s’s reproductive rights by superseding the procedures and knowledge of the FDA. Which medications are available to women seeking an abortion should be determined by knowledge, not by an intense right-wing philosophy.
Elizabeth Warren, Sen.( D – Mass. ) According to a statement, the ruling was” lawless” and” warned that women in the United States” might not have access to safe, legal medication.”
Warren urged the Biden administration to make every legal and regulatory measure possible to maintain the availability of this medication.
However, a few advocacy organizations have praised the judge’s’s ruling in Texas.
The decision, according to March for Life President Jeanne Mancini,” is a significant step forward for women and girls whose health and safety have been jeopardized for years by the FDA’s’s hurried, weak, and politicized endorsement of these harmful drugs.”
Brian Burch, the president of CatholicVote, referred to the decision as well late in a statement.
According to Church, the FDA has renounced its solemn duty to safeguard women and girls for years, prioritizing politics over safety and health.
The serious risks associated with taking these medications have been documented in numerous peer-reviewed studies and significant foreign studies,” Burch added. It’s’s time to hold the FDA accountable for disregarded the overwhelming body of evidence and demand that they act in the nations’ best interests for women and girls.
