A Mother’s Fight Against Racial Discrimination: Southwest Airlines Faces Lawsuit
A heart-wrenching incident unfolded in October 2021 when Mary MacCarthy, a white mother, and her multiracial daughter were accused of trafficking by Southwest Airlines employees. Now, MacCarthy has taken a stand and filed a racial discrimination lawsuit against the company.
MacCarthy and her 10-year-old daughter were on their way to Denver from Los Angeles to attend a funeral when they faced an unexpected ordeal upon landing. A flight attendant’s suspicion of potential human trafficking led to a confrontation with police officers.
“The only basis for the Southwest employee’s call was the belief that Ms. MacCarthy’s daughter could not possibly be her daughter because she is a biracial child.”
In her federal court filing, MacCarthy asserts that the flight attendant’s suspicion was rooted in a “racist assumption about a mixed-race family.” She emphasizes that there was no basis to believe she was trafficking her daughter.
As MacCarthy and her daughter walked down the jet bridge, they were pulled aside for questioning by the police, causing immense distress. The complaint highlights the emotional toll inflicted by Southwest Airlines’ alleged display of blatant racism.
“After significant questioning, during which Ms. MacCarthy’s daughter began to break down in tears, Ms. MacCarthy was eventually allowed to leave by the officers, but not before this display of blatant racism by Southwest Airlines caused Ms. MacCarthy and her daughter extreme emotional distress.”
A police report, previously released, revealed that the flight attendant expressed concern because the mother and daughter did not talk during the flight. However, MacCarthy denies this claim, stating that her daughter was listening to an audiobook and that they did communicate during the trip.
Southwest Airlines has declined to comment on the pending litigation, stating, “We don’t have anything to add right now on this pending litigation.”
In subsequent interviews, MacCarthy revealed that she now carries her daughter’s birth certificate with her to avoid similar incidents in the future.
The lawsuit seeks a jury trial, attorney costs and fees, and damages to be determined during the trial.
