Supreme Court Approves Biden Administration’s Authority to Regulate “Ghost Guns”

The Supreme Court has granted the Biden Administration the power to classify untraceable homemade weapons, known as “ghost guns,” as firearms under federal law.
The court’s decision removes a previous ruling and allows ghost gun regulations to remain in place while legal challenges from firearm manufacturers proceed in lower courts.
Ghost guns, which can be assembled from kits purchased in stores or online, have raised concerns due to their lack of serial numbers, background checks, and transfer records. Critics argue that they appeal to criminals and individuals prohibited from buying firearms.
In August 2022, the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) introduced regulations to address the issue. These regulations require commercial manufacturers and sellers to mark their products with serial numbers and maintain records for tracing firearms involved in criminal activities.
However, the regulations do not ban the sale or ownership of ghost gun kits. Instead, they enforce federal laws governing the commercial sale of firearms.
The gun manufacturers challenged the regulations in court, leading to a nationwide injunction. The Supreme Court temporarily reinstated the regulations in August, and now, they will take effect permanently.
In an emergency application, the Justice Department argued that ghost guns pose a grave threat to public safety due to their lack of background checks and traceability.
“The lack of background checks makes ghost guns uniquely appealing to felons, minors, and other prohibited persons – and because when ghost guns are inevitably used in crime, they are essentially impossible to trace,” said Solicitor General Elizabeth Prelogar.
The Supreme Court has rejected the lower court decisions, allowing the ATF regulations to take effect while legal proceedings continue.
