The Supreme Court ordered the Trump administration to return a man it mistakenly deported to a Salvadoran megaprison after the administration insisted to the high court that it had no authority to correct its error.
The Supreme Court wrote in a brief decision that a lower court judge in Maryland was correct to order administration officials to “facilitate” Kilmar Abrego Garcia’s return but added that the judge must clarify another part of her order that directed the administration to “effectuate” Abrego Garcia’s return immediately.
“The order properly requires the Government to ‘facilitate’ Abrego Garcia’s release from custody in El Salvador and to ensure that his case is handled as it would have been had he not been improperly sent to El Salvador. The intended scope of the term ‘effectuate’ in the District Court’s order is, however, unclear, and may exceed the District Court’s authority,” the decision read.
