Court supports elderly woman who lost home to foreclosure.
Supreme Court Rules in Favor of 94-Year-Old Grandmother
The Supreme Court unanimously sided on Thursday with a 94-year-old grandmother from Minnesota who lost her home due to foreclosure and subsequently lost the equity she had in the property that exceeded the amount of taxes she owed.
Hennepin County sold Geraldine Tyler’s condo at an auction for $40,000 after her home was seized for failure to pay taxes. Rather than returning the $25,000 difference between the sales price and what she owed, the county kept the balance and used the additional funds for public amenities.
“The taxpayer must render unto Caesar what is Caesar’s, but not more,” Chief Justice John Roberts wrote for the unanimous court.
A Victory for Property Rights
This landmark decision is a victory for property rights and a blow to government overreach. The Supreme Court’s ruling ensures that individuals are not unfairly stripped of their hard-earned equity, even in cases of tax delinquency.
Protecting the Vulnerable
Geraldine Tyler’s case highlights the importance of protecting vulnerable members of society, such as the elderly, from unjust treatment by government entities. The Supreme Court’s decision sets a precedent for fair treatment and due process for all individuals, regardless of their circumstances.
