Top Democrats Push for 14th Amendment to Disqualify Trump from 2024 Presidential Campaign
Top Democrats are advocating for the use of the 14th Amendment of the U.S. Constitution to prevent former President Donald Trump from running in the 2024 presidential campaign. Rep. Adam Schiff (D-Calif.) has called on the U.S. Supreme Court to make the final decision.
Section 3 of the 14th Amendment, which was enacted after the Civil War, prohibits individuals from holding office if they have engaged in “insurrection or rebellion” against the United States or have provided aid or comfort to its enemies. In an interview with MSNBC, Schiff emphasized that the 14th Amendment case against President Trump is a “valid argument.”
“The law doesn’t require that you be convicted of insurrection. It just requires that you have engaged in these acts,” Schiff explained. “It’s a disqualification from holding office… And it fits Donald Trump to a T.”

Schiff believes that the law will be tested when a secretary of state either refuses to include Trump on the ballot or faces a legal challenge for doing so. He anticipates that the case will eventually reach the Supreme Court, raising the question of how the Court will respond.
“There are prominent constitutional scholars as well as prominent progressive scholars who believe that he should be disqualified. But will the court take that step? Ultimately, only time will tell,” Schiff stated.
Another Democrat, Sen. Tim Kaine (D-Va.), also expressed support for removing President Trump from the 2024 ballot. In an interview with ABC, Kaine argued that the attack on the Capitol was intended to disrupt the peaceful transfer of power outlined in the U.S. Constitution.
“My sense is it’s probably going to get resolved in the courts,” Kaine said. “But, you know, I think what we have to focus on in our side is we just got to win in 2024.”
Kaine criticized 2024 Republican presidential contenders who have pledged to vote for Trump even if he is convicted of a crime. He believes that their willingness to support Trump despite his attempts to overturn the peaceful transfer of power demonstrates a lack of moral compass.
In response to the Democrats’ efforts, former Assistant U.S. Attorney Sol Wisenberg called their use of the 14th Amendment “hypocritical” and “anti-democratic.” He argued that allowing a state secretary of state to unilaterally declare someone ineligible for office without due process or a trial is absurd.
Disqualification Lawsuit Dismissed, Trump Warns of Retaliation
Recently, a federal judge from Florida dismissed a lawsuit that sought to disqualify President Trump from the 2024 race. The lawsuit, filed by Florida tax attorney Lawrence Caplan, argued for disqualification under Section 3 of the 14th Amendment.
However, Judge Robin L. Rosenberg, an Obama appointee, dismissed the case, stating that Caplan did not have a specific injury to bring a federal lawsuit against President Trump.
Amid the Democrats’ push to disqualify him, President Trump has warned of potential retaliation once Republicans regain power. In a post on Truth Social, he wrote, “The Crooked Joe Biden Campaign has thrown so many indictments and lawsuits against me that Republicans are already thinking about what we are going to do to Biden and the Communists when it’s our turn.”
