Texas celebrates as federal appeals court delivers major border victory over Biden administration
Texas Celebrates as Federal Appeals Court Hands State a Big Border Win Over Biden Admin
A federal appeals court has temporarily halted a ruling that allowed the Border Patrol to remove the barbed wire installed by Texas authorities on the border.
U.S. District Judge Alina Moses, appointed by George W. Bush, declined to issue an injunction blocking the federal government from removing the wire, despite criticizing the Biden administration’s handling of the border.
However, after Texas Attorney General Ken Paxton’s swift appeal, the 5th U.S. Circuit Court of Appeals issued an administrative stay, temporarily pausing the ruling.
Texas had sued the Biden administration for cutting the border wire in late October.
“I am pleased the court recognized the extent of the federal government’s blatant and disturbing efforts to subvert law and order at our State’s border with Mexico,” said Paxton in a statement.
“This is an important step supporting Texas’s right to protect our citizens from Biden’s doctrine of open borders at any cost,” the Republican added.

“Biden’s doctrine of open borders at any cost threatens the safety of our citizens, and we will continue to fight it every step of the way,” Paxton had previously stated.
In her ruling, Moses stated that the evidence “amply demonstrates the utter failure of the [Biden administration] to deter, prevent, and halt unlawful entry into the United States.”
“The law may be on the side of the Defendants and compel a resolution in their favor today, but it does not excuse their culpable and duplicitous conduct,” the judge added.
“The Defendants cannot claim the statutory duties they are so obviously derelict in enforcing as excuses to puncture the Plaintiff’s attempts to shore up the Defendants’ failing system,” she wrote.
“Nor may they seek judicial blessing of practices that both directly contravene those same statutory obligations and require the destruction of the Plaintiff’s property.”

The battle between the state of Texas and the Biden administration over border security has taken a new turn, with a federal appeals court siding with Texas in a recent ruling. This decision has sparked celebration among Texans who have long been concerned about the state’s border security.
The controversy revolves around the installation of barbed wire by Texas authorities on the border. Texas had taken the initiative to install this wire as a means of strengthening border security. However, the Biden administration had ordered the removal of the wire, arguing that it was unnecessary and potentially harmful.
U.S. District Judge Alina Moses, who was appointed by former President George W. Bush, declined to issue an injunction blocking the federal government from removing the wire. Although she expressed criticism of the Biden administration’s handling of the border, she did not see sufficient grounds to halt their decision.
Texas Attorney General Ken Paxton, however, was quick to appeal the ruling. In a swift move, he approached the 5th U.S. Circuit Court of Appeals, which issued an administrative stay, temporarily pausing the removal of the barbed wire.
This development has been welcomed by Texans who believe that the Biden administration’s approach to border security is inadequate. Attorney General Paxton expressed his satisfaction with the court’s decision and highlighted the federal government’s attempt to undermine law and order at the border.
Paxton emphasized the significance of this victory for Texas, stating that it supports the state’s right to protect its citizens from Biden’s doctrine of open borders. The Republican Attorney General believes that this ruling is a crucial step in safeguarding the interests of Texans.
The ongoing battle between Texas and the Biden administration reflects the broader debate on immigration and border security in the United States. While the Biden administration has sought to adopt a more lenient approach to immigration, many states, particularly those along the southern border, have expressed concerns about the potential security risks associated with this policy.
As the legal process continues, it remains to be seen how this case will ultimately be resolved. However, for now, Texans are celebrating this recent win in their efforts to protect their borders and ensure the safety of their communities.
