An Effort to Disqualify Donald Trump’s White House Bid
Two civil rights groups are taking action to disqualify former President Donald Trump from running for office again, citing the Jan. 6 Capitol riot as grounds for his disqualification under the 14th Amendment.
Mi Familia Vota, a nonprofit organization dedicated to uniting the Latino community, and Free Speech For People, an advocacy group fighting for political equality, have joined forces to launch the “Trump is Disqualified” campaign. The campaign’s goal is to educate voters and state officials about Section 3 of the 14th Amendment.
The Insurrectionist Disqualification Clause
Section 3 of the 14th Amendment prohibits individuals who have engaged in insurrection or rebellion against the Constitution, or provided aid or comfort to its enemies, from holding certain offices.
These groups are actively working across the country to prevent Trump from appearing on the 2024 ballot. They are urging secretaries of state and chief election officials through letters to utilize the insurrectionist disqualification clause to block Trump from any future ballot, as stated by Free Speech For People.
The campaign will kick off with a series of rallies and events outside the offices of the secretaries of state in California, Oregon, Colorado, and Georgia, according to the Hill.
In a letter addressed to Nevada Secretary of State Cisco Aguilar, the groups argued that allowing a known insurrectionist to appear on the ballot goes against the obligation and oath of office to support the U.S. Constitution. They emphasized that states have the authority to enforce the Constitution without needing permission from Congress.
Other organizations, such as the Project On Government Oversight, have also examined the use of the 14th Amendment in relation to the Jan. 6 Capitol riot. In a report released in November 2022, the organization concluded that the House Jan. 6 committee possesses the necessary evidence to trigger Section 3. The report highlighted the involvement of the former president, several members of Congress, and numerous individuals covered by Section 3 in a coordinated effort to overturn the election, potentially constituting an act of insurrection against the U.S. government.
