Tim Kaine suggests Trump could be disqualified from office.

Sen. Tim Kaine Defends Argument ⁤Against Trump’s Eligibility for Office

Sen. Tim ⁤Kaine⁤ (D-VA) passionately defended the notion that former President Donald Trump’s involvement in⁤ the⁢ Jan. 6 Capitol riot could potentially disqualify him from holding office under the 14th Amendment. Speaking on ABC’s “This Week,” Kaine described the attack as a deliberate attempt to disrupt the peaceful transfer ⁢of power outlined in the Constitution. He believes there is a strong case to⁢ be made, acknowledging⁢ that‍ the issue⁣ will likely be resolved in ⁣the ‌courts.

Surprise Among Arizona Republicans⁤ Over Blake Master’s Senate Run

Meanwhile, Kaine is⁣ not alone ‌in his examination of⁤ whether the ⁤14th Amendment could prevent Trump from seeking ‌reelection in 2024. Democratic⁤ lawmakers and legal scholars, including‍ Rep. Jamie ⁣Raskin (D-MD), have expressed similar views. Even former Arkansas ‌Gov. Asa Hutchinson, a Republican, ‍warned that ⁢the ⁢clause could potentially keep Trump⁢ off the ballots ‌during the first⁢ Republican presidential debate⁣ in Milwaukee.

Section 3 of‌ the ‌14th Amendment explicitly⁢ states that anyone who has taken an oath to uphold the U.S. Constitution cannot have engaged in insurrection or rebellion‌ against it, or provided aid or comfort to its enemies. ⁢Kaine emphasized the specificity‍ of the language, highlighting that it refers to insurrection against the‌ constitution‍ itself, not just the United States.

However, critics ⁢argue that Trump cannot be⁤ disqualified⁢ from‍ holding office under the ‌14th Amendment because he‍ has not been⁢ convicted in ‌a court of law or by Congress for participating in an insurrection or rebellion.

Multiple states,⁤ including Arizona, Michigan, and New Hampshire, are preparing‌ to⁣ counter legal efforts to⁢ remove Trump from the ballot⁣ based⁤ on the⁢ 14th Amendment. Lawsuits have ⁤been initiated in ⁣these states, with members‍ of the Republican Party vowing to fight⁣ to keep Trump’s name on the ballot. Chris Ager, a‍ Republican state committeeman in New Hampshire, affirmed their ‍determination to use all‌ available tools to prevent anyone’s access from being denied on⁤ the ballot.
