Trans daycare worker avoids prison after sexually abusing infant

A biological man who now identifies as a transgender woman and was accused of sexually assaulting an infant has entered into a plea agreement. If this individual continues to comply with the terms of the agreement, they will avoid going to prison in Kentucky.
Former childcare worker Maria Childers enlisted the help of a well-known trans activist attorney to defend them in this horrifying case.
After an anonymous complaint was made to the Department of Community Based Services (DCBS) regarding alleged abuse at Explore Learning Academy, Childers was finally arrested in February 2023 following a thorough investigation.
The tip, allegedly submitted by one of Childers’ coworkers, accused them of inappropriately touching the baby’s private parts and making inappropriate comments while changing the baby on a changing table.
Now that the press has access to the complete complaint against Childers, it is revealed that they were accused of both physical and sexual abuse during their time working at the daycare facility.
On February 8th, 2023, a DCBS case worker and a Paducah Police Department officer visited the daycare to speak with witnesses after receiving the first anonymous complaint. They were able to verify the allegation by speaking with numerous employees who had witnessed Childers’ disturbing behavior.
According to witness testimony, Childers was asked to help a coworker change an infant’s diaper. The coworker noticed that the baby seemed distressed as Childers was cleaning their genitalia and asked if Childers was hurting the child. The coworker then witnessed Childers “circularly” stroking the baby’s genitalia, stating, “That was her clit area, and she likes it. It just made her day.”
Despite being reported, Childers only received a “write up” from Academy management. The police later discovered that Childers had also been accused by other colleagues of neglecting children in high chairs for extended periods of time.
During interrogation at the police station, Childers initially denied changing the baby’s diaper at all. However, after an officer showed them a text message they had sent to the daycare director confirming the diaper change, Childers admitted to doing so. Childers then attempted to deny making any inappropriate remarks, claiming that their statements were frequently “taken out of context.”
Childers was subsequently taken into custody and charged with three counts of first-degree criminal abuse of a child under the age of twelve and one count of first-degree sexual abuse of a victim under the age of twelve. They were booked into the McCracken County Jail.
There has been confusion regarding the spelling of Childers’ last name, with variations between “Childers” and “Childres” used by the courts, police, and their social media accounts. In Kentucky Court of Justice records, their name is spelled “Childres,” while “Childers” appears under their own signature and in their defense files.
Although initially identified as ”male” by the police and the jail, internal records obtained by the outlet Reduxx show that the McCracken County Jail eventually changed Childers’ reported sex to “female.”
Court documents also revealed that Childers hired trans activist attorney Madison Leach on a private basis to represent them just one month after being detained.
Leach, who ran as a Democrat for the Calloway County attorney seat, became the first openly transgender candidate to run for public office in western Kentucky. They are a biological man who has identified as a transgender woman for seven years.
Leach filed a request to lower Childers’ bond, arguing that they were “deprived of estrogen” while held in solitary confinement at the McCracken County Jail.
The request was granted, and Childers’ bond was reduced from $100,000 to $5,000. The conditions of bail include staying away from the daycare where they worked and having no contact with minors.
In January 2024, Childers was released from detention.
Childers reached an agreement with prosecutors on January 29th, 2024. Their charge of First-Degree Sexual Abuse of a Victim Under 12 was modified to Class A Misdemeanor Sexual Misconduct in exchange for a guilty plea, and the other abuse counts were dropped.
Judge Joseph Roark imposed a “12-month penalty” on Childers but deferred sentencing and granted a six-month conditional release.
If Childers follows the court’s rules throughout the six-month term, they may avoid having a criminal record and prison time.
