A Trump-appointed federal judge denies Trump’s request to delay trial
In a significant development, a federal judge appointed by former President Donald Trump has declined his request to postpone his trial until after the 2024 presidential election. Judge Aileen M. Cannon, who is overseeing Trump’s prosecution on criminal charges related to his handling of classified documents, has ordered that the trial will commence on May 20, 2024. This decision comes at a crucial time, as most of the voting in the Republican Party’s presidential primary and caucuses will be completed by then.
A middle-of-the-road approach
Judge Cannon’s decision to push the trial back by several months reflects a compromise between the requests made by both the prosecutors and the defense. Special Counsel Jack Smith had initially sought for the trial to begin in December 2023, before any votes were cast in the presidential primaries and caucuses. On the other hand, Trump had pushed for a delay until after the presidential election on November 5, 2024.
The New York Times has reported that the jurors will be selected from counties that Trump “won handily” in the last two presidential elections, adding an interesting dynamic to the trial.
Equal treatment under the law
David Harbach, one of Smith’s top deputies who led the 2012 case against former Sen. John Edwards (D-NC), emphasized that Trump should be treated like any other U.S. citizen in this case. Harbach stated, “Mr. Trump is not the president. He is a private citizen who has been lawfully indicted by a grand jury in this district, and his case should be guided by the federal code and the rules of this court like anyone else.”
Trump’s legal team strongly disagreed with this assertion, arguing that it is “intellectually dishonest” to claim that this case is no different from any other. However, Judge Cannon did not address the argument made by Trump’s team regarding the potential bias resulting from publicity about the 2024 Presidential Election.
