Former President Donald Trump championed the Supreme Court‘s Monday ruling that Trump has some form of immunity from federal prosecution over his alleged efforts to overturn the 2020 election.
“BIG WIN FOR OUR CONSTITUTION AND DEMOCRACY. PROUD TO BE AN AMERICAN!” Trump posted on Truth Social moments after the ruling was issued.
An hour later, Trump followed up with a lengthier statement on the ruling that blasted President Joe Biden and several prosecutors who have brought charges against him.
“Today’s Historic Decision by the Supreme Court should end all of Crooked Joe Biden’s Witch Hunts against me, including the New York Hoaxes – The Manhattan SCAM cooked up by Soros backed D.A., Alvin Bragg, Racist New York Attorney General Tish James’ shameless ATTACK on the amazing business that I have built, and the FAKE Bergdorf’s “case.” PROUD TO BE AN AMERICAN!” Trump continued.
The high court’s Trump v. United States decision likely gives Trump a temporary reprieve from seeing special counsel Jack Smith’s four-count indictment go to trial ahead of the 2024 presidential election.
“Under our constitutional structure of separated powers, the nature of Presidential power entitles a former President to absolute immunity from criminal prosecution for actions within his conclusive and preclusive constitutional authority. And he is entitled to at least presumptive immunity from prosecution for all his official acts. There is no immunity for unofficial acts,” Chief Justice John Roberts wrote in a 6-3 majority opinion.
Smith argued that Trump’s actions surrounding the 2020 election and the subsequent Jan. 6 Capitol riot were not part of his presidential duties and not eligible for protection.
The decision gave Trump another win after last week’s first presidential debate against Biden in which the president appeared feeble, prompting Democratic panic.
Republican leaders on Capitol Hill once again came to Trump’s aid and blasted Smith’s case against Trump.
“Hyper-partisan prosecutors like Jack Smith cannot weaponize the rule of law to go after the Administration’s chief political rival, and we hope that the Left will stop its attacks on President Trump and uphold democratic norms,” House Judiciary Committee Chairman Jim Jordan (R-OH) said in a statement Monday. “The Judiciary Committee will continue to oversee dangerous lawfare tactics in our judicial system.”
Republican National Committee chairman Michael Whatley called the ruling “a victory for the rule of law and a reminder that the Constitution outweighs the left’s weaponization of the judicial system against President Trump and his allies.”
Biden’s campaign, on the other hand, continued to slam Trump’s actions following the 2020 cycle, calling him “unhinged” and pointing to his conviction of 34 felony counts in the New York hush money case.
“Today’s ruling doesn’t change the facts, so let’s be very clear about what happened on Jan. 6: Donald Trump snapped after he lost the 2020 election and encouraged a mob to overthrow the results of a free and fair election,” a senior Biden campaign adviser said. “Trump is already running for president as a convicted felon for the very same reason he sat idly by while the mob violently attacked the Capitol: He thinks he’s above the law and is willing to do anything to gain and hold onto power for himself.”
