A Florida Tax Attorney Sues Donald Trump, Seeking to Bar Him from Holding Public Office Again
A Florida tax attorney is taking legal action against former President Donald Trump, aiming to prevent him from holding public office in the future. The lawsuit, filed by Palm Beach County lawyer Lawrence Caplan, cites the Capitol incursion on January 6, 2021, as a “disqualification” under the 14th Amendment.
In the lawsuit, Caplan argues that Trump is constitutionally prohibited from seeking a second term as President and questions whether he should be allowed to participate in the upcoming Florida Republican Party primary scheduled for March 19, 2024.

Caplan, in an interview with The Hill, explained that he filed the lawsuit because someone needed to challenge Trump’s eligibility to hold office again. He expressed concerns about Trump’s potential impact on democracy, stating, “This is a scary, scary guy, and if he’s president, I think we’re all on the way to fascism. There’s no law that says we have to remain a democracy forever.”
The lawsuit is based on Section 3 of the 14th Amendment, which prohibits any U.S. citizen from holding public office if they have engaged in insurrection or rebellion against the United States. Caplan argues that Trump’s involvement in the events of January 6th puts him at the center of the disqualification clause, making him ineligible to serve in federal office again.
Caplan’s case raises an important question about whether American jurists will uphold the Constitution in this matter. He points out that three Supreme Court justices were appointed by Trump, emphasizing the need for impartiality in interpreting the law.
While Trump faces criminal charges related to the 2020 election, Caplan’s lawsuit adds another legal battle to his plate. Despite these challenges, Trump’s poll numbers remain high compared to his GOP primary rivals.
