Former President Trump’s Attorney Defends Rejection of Protective Order
Alina Habba, attorney for former President Donald Trump, appeared on Fox News to address the proposed protective order that Trump’s team rejected. In her interview, Habba accused special counsel Jack Smith of trying to play the victim. She emphasized that while they have agreed to protective orders in the past, this particular one raised concerns.
Protective Orders and Witness Testimony
Habba clarified that they have no objections to protective orders that ensure the safety of witnesses and classified evidence. However, she pointed out that the current order sought by Smith is different. Habba defended Trump’s compliance with previous orders and suggested that Smith’s fear may be the driving force behind this particular request.
The Department of Justice had previously filed a protective order in a case involving classified documents. The judge granted the order, allowing Trump access to discovery materials from his Mar-a-Lago estate only under the supervision of his defense counsel or their staff.
Regarding witness testimony exhibits, Habba stated that they have never disagreed to such orders in the past, and Trump has always abided by them.
Protective Order on Social Media Usage
Prosecutors requested a protective order from Judge Tanya Chutkan to restrict Trump’s social media usage in the case. They argued that Trump’s posts could potentially harm witnesses or impede the fair administration of justice. When asked about reviewing Trump’s social media posts, Habba stated that she couldn’t speak to the matter, as he is a grown man who acts as he wishes.
Trump’s legal team sought an extension for the deadline, but Chutkan denied the request. They also rejected Smith’s order by the given deadline. Trump’s attorneys argued that the order was too broad and suggested a more limited protective order that only covers sensitive materials.
Attorney’s Perspective on the Protective Order
Although Habba is not directly involved in the 2020 election case, she expressed confidence in the response from the other attorney, emphasizing that they do not have issues with certain aspects of the protective order. However, she strongly opposed the idea of a gag order on a presidential candidate under attack, deeming it unconstitutional.
