Bragg is being investigated by the prosecution for the first ever indictment against a former president in U.S. History. There are some concerns about how strong a criminal case Bragg can build. The legal case could hinge upon whether Trump falsified business records by listing Cohen’s reimbursement payments to Daniels in legal expenses. This crime is currently a misdemeanor in New York, but it could be elevated to a felony by Bragg’s office if the fraud was meant to cover up another crime.
