Special Counsel Rejects Trump’s Attempt to Delay Trial
Former President Donald Trump’s bid to postpone his federal trial in Washington, D.C., until 2026 has been met with resistance from Special Counsel Jack Smith. Smith argues that such a delay would infringe upon the public’s right to a speedy trial.
“In service of a proposed trial date in 2026 that would deny the public its right to a speedy trial, the defendant cites inapposite statistics and cases, overstates the amount of new and non-duplicative discovery, and exaggerates the challenge of reviewing it effectively,” Smith’s team stated in a court filing on Monday.
Prosecutors Dismiss Trump’s Trial Date Proposal
Trump’s legal team had suggested an April 2026 trial date, citing the massive amount of potential evidence provided by prosecutors, which amounts to 11.5 million pages. However, Smith’s team argues that a significant portion of this evidence consists of duplicate pages or information already available to the public, such as documents from the House committee investigating the Capitol riot and Trump’s social media posts.
Prosecutors also took issue with the Trump team’s use of creative metaphors to describe the volume of materials. They emphasized that the burden of reviewing discovery cannot be measured by page count alone and that comparisons to the Washington Monument’s height or the length of a Tolstoy novel are unhelpful distractions.
Furthermore, Smith’s team pointed out that Trump’s proposal is based on the false assumption that attorneys would need to manually review all the discovery, which is not consistent with modern practices.
Prosecutors Suggest an Earlier Trial Date
Prosecutors have put forward a trial date of January 2, 2024. The final decision on the scheduling request will be made by Judge Tankya Chutkan, potentially as early as the next status conference on August 28.
