Trump’s Attorney: Trump Will Surrender To Authorities If He Is Criminally Charged

According to Trump’s lawyer, former President Donald Trump will surrender before law enforcement officials if indicted by Manhattan grand juries over crimes related to an $130,000 hush-money payment to pornstar Stormy Dans.

Joseph Tacopina’s remarks were in response to a report by NBC News that stated that federal, state and local law enforcement agencies were analyzing security assessment and planning for Trump’s possible indictment.

Fox News reported on the request by Manhattan District Attorney’s office for a meeting to discuss law enforcement issues. “discuss logistics for some time next week, which would mean that they are anticipating an indictment next week.”

Tacopina said to the New York Daily News: “If Trump is arrested, “there won’t be a standoff at Mar-a-Lago with Secret Service and the Manhattan DA’s office.”

CNBC was later informed by Tacopina that they “will follow normal procedures if it gets to that point.”

The New York Times reported this week that prosecutors would not be seeking an indictment at this stage due to the number of witnesses being questioned before the grand jury, and the offer made by them to Trump to testify in front the jury.

The case revolves around an alleged payment that Michael Cohen (ex-Trump attorney) made to Daniels during his presidential campaign. Cohen pleaded guilty and was sentenced to felony charges.

Trump’s potential problem centers on Cohen’s company payment. The expense was claimed as a legal expense. Cohen’s retainer agreement was cited by the company. The retainer agreement didn’t exist, and the reimbursement wasn’t related to any legal services provided by Cohen. This leads to a possible misdemeanor criminal conviction for falsifying records in business. According to the report, Trump signed several checks to Cohen during his presidency.

If the prosecution can prove that Trump committed the offense, they may make it a felony. “‘intent to defraud’ included an intent to commit or conceal a second crime.”

Prosecutors contend that the second offense is that the $130,000 hush donation was an inappropriate donation to Trump’s presidential campaign. This was because it was used to stop a story in order to benefit his presidential campaign.
