Tucker Carlson’s Jan. 6 footage creates legal headache for DOJ prosecutions

The latest court filing comes from lawyers representing the Proud Boys. They have made numerous accusations against the government. U.S. District Judge Timothy Kelly was appointed by former President. He denied all their previous requests. Donald Trump.

Harvey Silverglate, a Boston defense attorney, spoke to the Washington Examiner Carlson’s footage appeared to show U.S. Capitol Police accompanying the infamous “QAnon Shaman” Jacob Chansley could be a prelude to an appeal to vacate his guilty sentence. Through bargaining, he was reduced to a single count for obstruction of an official proceeding, which landed him 41 months in prison.

“Virtually every moment of his time inside the Capitol was caught on tape,” Carlson stated Monday. “The tapes show the Capitol Police never stopped Jacob Chansley. They helped him. They acted as his tour guides.”

Silverglate, a criminal defence and civil liberties attorney representing John Eastman (onetime Trump attorney), said “I think that he can get his guilty plea vacated,” Chansley is the person referring to, but Chansley has not yet filed an appeal or requested a retrial.

“He certainly is going to try. I think he will probably succeed,” Silverglate added, “It’s not the defense’s fault [the footage] wasn’t turned over.”

Roger Roots, an attorney representing Dominic Pezzola in New York, claimed that the footage from Carlson to Chansley was evidence that protesters entered the Senate chamber at the invitation of Capitol Police officers. Roots claimed that the prosecutors “withheld” The footage was provided by his client.

“This footage is plainly exculpatory; as it establishes that the Senate chamber was never violently breached, and — in fact — was treated respectfully by January 6 protestors,” Roots Write The 11-page court filing. “To the extent that protesters entered the chamber, they did so under the supervision of Capitol Police. The Senators on January 6 could have continued proceedings.”

Roots also claimed it wasn’t Pezzola and his co-defendants who caused Congress to recess the day after the riot. “Congress interrupted its own proceedings.”

Pezzola is not mentioned in the filing. Pezzola can be seen in video taken at the hearings of the House Select Committee on the Jan. 6 Riot smashing one Capitol window that day. He pleaded guilty to not all charges
