Why Donald Trump Is Not Going To Trial Anytime Soon

Despite allegations that have been made against him, former president Donald Trump is unlikely to face trial anytime soon. This is largely due to the fact that the Secret Service will work to protect him, making it unlikely that he will be taken into custody. Additionally, New York County District Attorney Alvin Bragg’s selective prosecution of Trump has been called into question, and his charges are not really justifiable.

Bragg has brought charges against Trump that are similar to littering, and has ignored countless other alleged felonies in the city. Many people believe that his prosecution of Trump is nothing more than buffoonery. Furthermore, all lawyers are expected to avoid even the appearance of impropriety in their conduct, which would make Bragg’s behavior a clear violation of ethical standards.

Bragg believes that there is a “Trump exception” to his questionable tactics, but many people believe that this is a step too far. Even if there is a trial, which is unlikely to begin anytime soon, Bragg’s selective prosecution is sure to be a central issue that will be raised during the proceedings.

The Charges Against Trump Aren’t Substantial

Bragg has likely brought two kinds of charges against Trump in an indictment that should have already been unsealed. However, the charges for allegedly bad paperwork are barred by the long-expired statute of limitations. Bragg will argue that efforts to hide other alleged crimes extend the time for him to charge Trump. However, this makes little sense and would essentially allow a criminal to avoid prosecution by not turning himself in. It is unlikely that this argument will be accepted.

Bragg will also try to fold federal campaign-related charges into a state prosecution. This is something that no one has ever attempted before, as it makes no legal sense and is considered to be blatant bootstrapping. Even if the case does eventually make it to trial, it is likely that Bragg’s charges will be dismissed as defective based on grounds that include the statute of limitations.

Will Trump Get a Fair Trial?

If the case does go to trial, it will be difficult to predict whether Trump will be treated fairly. Some believe that the assigned judge will be biased against him, while others believe that he will be given an unfair advantage. Either way, the trial will be nerve-wracking, and the outcome will be uncertain.

If Bragg’s case survives legal and procedural challenges, there will be requests to change venue to get out of NYC. Those will likely be denied. A jury would then hear all the facts and render a verdict.

Regardless of what the next several months bring, people should be careful about what they read about the case. Many people believe that much of what is being reported is untrue. President Trump is not likely to be taken into custody anytime soon, and there will be no inevitable outcome to this case.

Regardless of how the case is resolved, it is clear that Democrats have been willing to cast aside norms and standards in order to pursue their goal of prosecuting Trump. This has created a deeply divisive situation that will likely have lasting effects on the American judicial system.
